Terms of use

  1. The terms and conditions hereunder (“Terms of Use”) shall apply to the use of the website www.pice.one, mobile application ‘PICE App’ and any other allied pages, softwares, features, content or application services (“Platforms”) offered or operated by Nanosecond Technologies Private Limited (“Company”).
  2. Any person logging on to, or using or browsing any of the Platforms (even when such person does not avail of any services provided by the Company through the Platforms (“Services”)) shall be a “User” (“You”) and shall be deemed to have read and unequivocally accepted and agreed to be bound by these Terms of Use (including the Privacy Policy uploaded to the website of the Company). These Terms of Use shall supplement, and not override the terms / conditions of any other specific written agreement for Services that the User and the Company may have entered into.
  3. If You do not agree to these Terms of Use in any manner, please terminate Your use of this website and the other Platforms. You shall be deemed to have accepted these Terms of Use irrespective of whether You are a registered member or visitor, and the Company shall have the ability to bind You to these Terms of Use.
  4. The ‘Privacy Policy’ is provided separately, but forms an integral part of Your use of the Platforms and should be read together with these Terms of Use. To the extent any of the provisions of these Terms of Use (including the Privacy Policy) are declared void or unenforceable under law, the rest of the provisions hereof shall continue as is, and shall be binding upon the User.
  5. Subject to these Terms of Use and the various policies of the Company, the Company offers the services set out in Schedule A hereto (as amended from time to time, at the sole discretion of the Company).

This End User Agreement (the “Agreement”) is made between you (the “User” or “You”) and NANOSECOND TECHNOLOGIES PRIVATE LIMITED (hereinafter referred to as “Pice”), a private limited company having its registered office at Opposite to NIFT College, 27th Main Road, 3rd Floor, #2726, Pice Office, 16th Cross Road, Sector 1 HSR Layout, Bengaluru Urban, Karnataka, 560102. (“Pice”, “Us” or “We”, which term shall include its successors and permitted assigns). The User and Pice shall be collectively referred to as the “Parties” and individually as a “Party”.

You hereby consent to Pice being appointed as your authorized representative to receive your Credit Information from Experian for the purpose of providing digital payments and lending services through “Pice (“End Use Purpose”) on ongoing basis for a period not exceeding a period of six (6) months.

BY EXECUTING THIS AGREEMENT / CONSENT FORM, YOU ARE EXPRESSLY AGREEING TO ACCESS THE EXPERIAN CREDIT INFORMATION REPORT AND CREDIT SCORE, AGGREGATE SCORES, INFERENCES, REFERENCES AND DETAILS (AS DEFINED BELOW)(TOGETHER REFERRED TO AS “CREDIT INFORMATION”). YOU HERE BY ALSO CONSENT TO SUCH CREDIT INFORMATION BEING PROVIDED BY EXPERIAN TO YOU AND THE CLIENT BY USING EXPERIAN TOOLS, ALGORITHMS AND DEVICES AND YOU HERE BY AGREE, ACKNOWLEDGE AND ACCEPT THE TERMS AND CONDITIONS SET FORTH HEREIN.

Terms and Conditions

Information Collection, Use, Confidentiality, No-Disclosure and Data Purging

CLIENT shall access your Credit Information as your authorized representative and CLIENT shall use the Credit Information for limited End Use Purposes consisting of and in relation to the services proposed to be availed by you from CLIENT. We shall not aggregate, retain, store, copy, reproduce, republish, upload, post, transmit, sell or rent the Credit Information to any other person and the same cannot be copied or reproduced other than as agreed herein and in furtherance to CICRA.

The Parties agree to protect and keep confidential the Credit Information both online and offline.

The Credit Information shared by you or received by us on your behalf shall be destroyed, purged, and erased promptly upon the completion of the transaction/ End Use Purpose for which the Credit Information report was procured for up to a maximum of 6 months.

Governing Law and Jurisdiction

The relationship between you and the CLIENT shall be governed by the laws of India and all claims or disputes arising there from shall be subject to the exclusive jurisdiction of the courts of Mumbai.

Definitions:

Capitalized terms used herein but not defined above shall have the following meanings:

“Business Day”   means a day (other than a public holiday) on which banks are open for general business in Mumbai.

“Credit Information Report”   means the credit information/scores/aggregates/variables/inferences or reports which shall be generated by Experian.

“Credit Score”   means the score which shall be mentioned on the Credit Information Report which shall be computed by Experian.

“CICRA”   shall mean the Credit Information Companies (Regulation) Act, 2005 read with the Credit Information Companies Rules, 2006 and the Credit Information Companies Regulations, 2006, and shall include any other rules and regulations prescribed thereunder.

CRIF High Mark Credit Score Terms and Conditions

In connection with submission of the application for my credit information (“Consumer Credit Information”) offered by CRIF High Mark Credit Information Services Pvt. Ltd ("CIC") through Neokred Technologies Private Limited (referred to as the "Company") and delivery of the Consumer Credit Information to the Company, I hereby acknowledge and agree to the following:

  1. The Company is my lawfully appointed agent and he / it has agreed to be my agent obtain my Credit Information Report and Credit Score from CRIF High Mark Credit Information Services Pvt. Ltd (CRIF High Mark) for the purpose of fetching Consumer Credit Information Report and not for ary other purposes. This consent shall be valid for a maximum period of 6 months or till such time the credit Information is required to be retained to satisfy the purpose for which it was intended, or I withdraw my consent to stare such credit information, whichever is earlier.
  2. I hereby expressly grant unconditional consent to, and direct, CIC to deliver and / or transfer my Consumer Credit Information to the Company on my behalf
  3. I shall not hold CIC responsible or liable for any loss, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to; (a) delivery of my Consumer Credit Information to the Company; (b) any use, modification or disclosure by the Company of the contents, in whole or in part, of my Consumer Credit Information, wherever authorized by me; (c) any breach of confidentiality or privacy in relation to delivery of my Consumer Credit Informatien to the Company;
  4. I acknowledge and accept that: (a) CIC has not made any promises or representations to me in order to induce me to provide my Consumer Credit Information or seek any consent or authorization in this regard; and (b) the implementation of the Agreement between CIC and the Company is solely the responsibility of the Company.
  5. I agree that I may be required to record my consent / provide instructions electronically or physically as the case may be, and in all such cases I understand that by clicking on the "I Accept” button below or signing this Consent physically, I am providing "written instructions” to Company authorizing Company to obtain my Consumer Credit Information from my personal credit profile from CRIF High Mark. I further authorize Company to obtain such information solely to confirm my identity and display my Consumer Credit Information to me. Further in all such cases by checking this box and clicking on the Authorize button or signing this Consent physically, I agree to the terms and conditions, acknowledge receipt of CIC privacy policy and agree to its terms, and confirm my authorization for Company to obtain my Consumer Credit Information.
  6. I understand that in order to deliver the product to me, I hereby authorize Company, to obtain my Consumer Credit Information from CIC.
  7. By submitting this registration form, I understand that I am providing express written instructions for Company to request and receive a copy of my consumer credit report and score from CIC.
  8. I understand that the product is provided on an “as-is”, “as available” basis and CIC expressly disclaims al! warranties, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.
  9. I shall not sue or otherwise make or present any demand or claim, and I irrevocably, unconditionally and entirely release, waive and forever discharge CIC, its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter “Releasee"), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) (“Losses”), whatsoever, in law or equity, whether known or unknown, which I ever had, now have, or in the future may have against the Releasee with respect to the submission of my Consumer Credit Information and / or my decision to provide CIC with the authority to deliver my Consumer Credit Information to the Company. I agree to defend, indemnify, and hold harmless the Releasee from and against any and all losses resulting from claims made against CIC by third parties arising from and in connection with this letter.
  10. I agree that the terms of this confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Mumbai in regard to any dispute arising hereof.

Detailed Terms

1 Overall terms of use; Explicit authorisations
  1. The User may be required to open an account with the Company by providing certain information (including know-your-customer (“KYC”) details) as part of the registration process to avail of the Services / in order to continue to avail of the Services.
  2. The Users will be required to provide the Company with personal information in order to retrieve or collect data / information from third party websites (in order for the Company to provide the Services). Such websites may be maintained by financial institutions / third parties with whom the Users have accounts, bank with or have created certain liabilities with. The Company does not and shall not assume any responsibility or liability towards the accuracy of information or data maintained by any third party (in terms of updation, accuracy, deletion, failure to store data correctly, or otherwise).
  3. The Company may collect the details of the User’s Permanent Account Number (PAN). By providing these details to the Company, the User authorises the Company to access and retrieve all data and information associated with the PAN number of the User, and for the use of such data and information for the provision of the Services.
  4. The user understands that a charge of Rs.2 is charged every time he/she links their cards to Pice. This charge is non-refundable.
  5. The company does not promote or endorse going against any clauses mentioned in the agreement signed between the user and their Financial Institution.
  6. The company shall not be held responsible (i) for any refund or cancellation incase of a successful transaction that has been denied or refunded by the user’s beneficiary. (ii) if the user has due to their own negligence, transferred money to an account they did not intend to.
  7. The User is solely liable and responsible for any and all data and information provided by the User (including the authenticity and verifiability thereof). The User confirms that all data and information provided by the User to the Company or to any third parties through the Platforms shall at all times be complete, accurate, correct, true and updated / latest. If the User provides any data or information that is incomplete, inaccurate, incorrect and / or false in any manner and / or if the Company reasonably assesses the User of being non-compliant with any applicable law in any manner, the Company reserves the right to reject or suspend the User’s registration and account and may also refuse to provide the User with access to the Platforms / Services. The User agrees to unconditionally indemnify, defend and hold harmless the Company from any and all claims arising out of or in connection with any data or information provided by the User to the Company or to any third party in connection with the use of the Platforms and / or Services. The User may update any data or information provided to the Company in the account section of the User on the Platforms. To the extent the User chooses to delete any of its information or data on the account, the User acknowledges that the Company may require reasonable time to process such deletion. The Company reserves the right to maintain a backup of the User’s account and information / data, as required under applicable law and / or for internal operations.
  8. The Company urges Users to keep all User data confidential (including specifically the login and password details for the account maintained with the Company). The Company explicitly disclaims all liability arising out of or in connection with the User’s failure to protect its data / information (including the login and password details of the User’s account(s)). Please contact the Grievance Officer in case you suspect a breach or would like to block your account.
  9. The User hereby provides to the Company an irrevocable, royalty-free, non-exclusive, worldwide, perpetual, and sub-licensable right to exercise the copyright, publicity and database rights in the data and information provided by the User to the Company, in order for the Company to be able to use such data for the provision of the Services. To expound, in order for us to provide the Services, the Users shall need to provide us with information, data, passwords, usernames, personal identification numbers, etc. and the Users hereby grants the Company to license and right to utilize all such data and information for and on the Users’ behalf, for the purposes of provision of the Services.
  10. The User is solely responsible and liable for its data and information, and undertakes not to publish, disseminate, deal in, transmit, update, download, share, etc. any information or data that: (i) belongs to any person other than the User or infringes any intellectual property or other rights of any other person, (ii) is harmful, deceptive, menacing, derogatory, defamatory, harassing, obscene, seditious, libellous, hateful, objectionable, disparaging, unlawful, or is capable of inciting any behaviour of the nature stated above (including encouraging money laundering, gambling or any morally objectionable acts), (iii) may cause harm in any manner to any person (including specifically minors), (iv) impersonates any other person, (v) contains malware, viruses or contains the potential to disrupt or adversely affect or impact the functioning of any computer resource or platform or business, (vi) is or may be construed to be a threat to the security, sovereignty, unity, integrity, defense, etc. of the Republic of India or any other nation-state or threatens in any manner any relationship that any nation-states may have with each other. To the extent that the Company finds or believes the data / information / content shared by the User to be objectionable, the Company shall have the right at its sole discretion to remove / edit such information. Users may report any objectionable behaviour / acts on the Platforms to the Grievance Officer.
  11. The User agrees that: (i) any data belonging to the Company may be accessed by the User only for personal purposes and not for any other use (including commercial or business use), unless consented to by the Company, (ii) it shall not access or attempt or threaten to access any of the Services except through the interface and platform provided by the Company, (iii) it shall not engage in any disruptive activity that could affect or impact the Services or Platforms in any manner, (iv) duplicate, replicate, deal with, sell or license onwards in any manner any Services being provided by the Company.
  12. The Company reserves the right to share any information / data provided by or generated by the User with all governmental, judicial, quasi-judicial, administrative, legislative and regulatory agencies, if the need so arises.
  13. The Company reserves the right to share any information / data provided by or generated by the User with trusted partners in order to provide a service.
  14. The use of the Platforms and Services are at the Users’ sole risk and the Services are provided by the Company on an ‘as is’ and ‘as available’ basis and without any warranty attached thereto. The Company does not provide any warranties as to the information / content on the Platforms, etc. being accurate, complete or updated, the use of the Services being uninterrupted, timely, secure or free from error, etc. The User acknowledges that the Company shall not be liable for any damage to its computer or IT systems or infrastructure or any loss of data that results from the download of any material from the Platforms / as part of the Services. The Company disclaims all warranties of any kind, whether express or implied, including, the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.
  15. The User acknowledges that the Company may suspend the use of any account if it comes to the Company’s notice that a fraudulent transaction has occurred on the Platforms.
  16. Certain Services or parts thereof may be supported by ad revenue and may display ads or promotions, and the User consents to the placement of such ads and promotions.
  17. In case any discounts or offers are being offered, please refer to the detailed terms and conditions on the dedicated page shared along with the offer communication.
  18. By accepting these terms, the User authorises the Company to hold, receive, disburse and settle funds on the User’s behalf. The User’s authorisation allows the Company to generate and facilitate electronic funds transfers between the source and beneficiary accounts. These authorisations shall remain valid until such time as the User’s account with the Company is terminated or closed.
  19. The User may at any time (by notice in writing to [email protected]) require the Company to terminate or close the User’s account with the Company and delete all data pertaining to the User, in which case, the Company shall do the needful within 10 days of receiving such notice.
  20. Where the Company provides a link to the websites / platforms of any third party financial institutions, the Company merely facilitates easy access for the User to make payments, i.e., any and all transactions between the User and its designated financial institutions shall strictly be between the relevant parties (and the Company shall not be privy to this / responsible for this in any manner).
2 Eligibility Criteria

Users shall need to be above 21 years of age and competent to contract under applicable laws, in order to access the Platforms and avail of the Services. The User, by agreeing to be bound by these Terms of Use, hereby also represents and acknowledges that it is competent to contract (and where the User is registering itself as a business or corporate entity, that due corporate authorisation has been provided to enter into these Terms of Use). The User shall be responsible for all of the User’s conduct on and the usage of the Services and the Platforms. If any of the above were to be untrue, the Company may revoke a User’s usage of the Platforms / Services.

3 Credit Card Usage, Cash Back and Rewards

By utilizing Pice’s services, users acknowledge that the use of their credit cards for business-related payments is at their sole discretion. It is noted that certain financial institutions may restrict or disallow the use of personal credit cards for business transactions, and any such limitations imposed by the user’s bank are beyond the purview and responsibility of Pice. Users are expressly responsible for abiding by their respective bank’s Most Important Terms and Conditions (MITC) concerning their credit cards. We strongly advise users to review their bank’s Most Important Terms and Conditions (MITC) and restrictions outlined in the same to Cardholders before utilizing their cards for payments through Pice. It is crucial to note that Pice processes transactions using four distinct merchant category codes: Vendor, Rent, Utility, and Tax, contingent upon the specific nature of the transaction initiated by the merchant. While numerous banks do not offer reward points or cash back for business-related payments made via retail or select corporate credit cards, users are urged to consult their credit card’s reward policy for validation of this information. Pice cannot be held liable for any discrepancies or lack of benefits as stipulated by credit card reward policies.

4 Intellectual Property Rights

All information, data, text, logos, photos, videos, clips, posts, comments, software, graphics, interactive features, or the like generated or provided through the Services or on the Platform may be protected by the intellectual property rights of persons other than the User. Such content may not be modified, rented, leased, loaned, sold, distributed, or dealt with in any other manner by the User. The Company reserves the right to moderate and take all actions deemed necessary by it in relation to such content. The User agrees that in using the Platforms / Services, the User may be exposed to content that it finds objectionable or offensive and to this extent, the User agrees to use the Services at its own risk and peril. The Company bears no responsibility whatsoever for any content created, transmitted or displaced by the User in using the Services / Platforms. The User understands and acknowledges that the Company or its licensors own(s) all rights, title and interests in and to the Platforms and Services; and that at no time shall the User use or authorise the use of any of the Company’s trade names, marks, logos, domain names and / or other distinctive brand features. No confidential information contained in the Services may be disclosed by the User at any time, without the Company’s prior consent.

5 Compliance with applicable laws

The User undertakes and shall be compliant at all times with all applicable anti-bribery and anti-corruption laws (worldwide). The User in addition agrees and undertakes that it is compliant with and shall continue to be compliant with the provisions of all KYC, anti-money laundering, and other guidelines and laws issued by the RBI and other authorities from time to time. The User shall also be compliant at all times with the mandates of the OFAC (i.e., the Office of Foreign Assets Control, USA).

6 Representations, Warranties and Indemnities

Each User hereby represents and warrants that: (i) the User is competent to contract and fully eligible to avail of the Services / use the Platforms, (ii) the User is an Indian resident with valid credentials and is legally eligible to carry on business in India, (iii) all information, data and documentation provided by the User to the Company at any and all times are true, accurate, correct and genuine (and that the Company shall not be responsible or liable for its genuineness, authenticity or veracity), (iv) the User shall be liable for all liabilities arising in connection with the information / data provided by the User, (v) the User is solely responsible for understanding and complying with all applicable laws, (vi) the User’s information technology systems and infrastructure are compliant with all applicable data security standards, (vii) the User shall use the Platforms and avail of the Services per the terms mandated by the Company and for no other purpose, (viii) the User shall not engage in any Restricted Actions (as set out below) when availing of the Services or using the Platforms, (ix) the User understands that all data, information, inventions, intellectual properties, know-how and processes, etc. used in the Platforms or Services shall be the sole property of the Company, (x) the User shall not store any customer card / related data in any form or manner, (xi) the User shall cooperate at all times with the Company to ensure compliance with these Terms of Use and all other policies of the Company, and (xii) the User shall at no time exploit (whether for monetary gain or otherwise) any feature of the Platforms / Services provided by the Company that are intended to facilitate functioning of the business of the Company / services of the Company in ordinary course (including any schemes, discounts, offers, etc.). To the extent that a User identifies or discovers any feature of the Platforms / Services that could reasonably harm / adversely impact / lead to the unfair or unintended exploitation of the Company’s resources, Platforms, Services, etc., the User undertakes to act in good faith and immediately notify the Grievance Officer of such issues / concerns.

The User agrees to indemnify, defend and hold harmless the Company, its founders / promoters, directors, employees, officials, agents, affiliates and representatives, from any and all losses or liabilities (including any claims, demands, proceedings, actions, etc.) arising out of or in connection with: (i) any discrepancy in the documents / data / information submitted or provided by the User to the Company (including for KYC formalities), (ii) fraud and / or negligence and / or misconduct by the User when using the Platform or Services or otherwise that could impact the Company adversely in any manner, (iii) violation of any applicable law by the User, (iv) breach of these Terms of Use (or any part hereof), (v) breach or inaccuracy of the representations and warranties of the User, (vi) fines / penalties / changes imposed by any third party on account of transactions by the User on the Platform / when availing of the Services.

The user will not hold Company or its third party service provider liable / institute complaint under the Telecom Commercial Communications Customer Preference (TRAI) Regulations, 2010 or such other applicable regulations including any amendment thereof, as may be applicable from time to time. It will be auto renewed every month and can be unsubscribed by contacting Grievance-cum-Nodal Officer.

The Company shall at no time be liable (whether by itself or through its founders / promoters, directors, employees, officials, agents, affiliates or representatives) for any direct, indirect, incidental, special, consequential, punitive or exemplary damages which may be incurred by the User (including any loss of profit, any loss of goodwill / business reputation, loss of data suffered, cost of procurement of substitute goods or Services, or other intangible loss).

The User acknowledges that a breach of these Terms of Use or any policies of the Company shall cause irreparable harm and damage to the Company, Accordingly, indemnity shall not be deemed to be an exclusive remedy but shall be in addition to all other remedies available under applicable law or in equity.

7 Confidentiality

The User may have access to certain confidential and proprietary information belonging to the Company and / or other persons, and the User hereby agrees to keep all such information in strict confidence and shall not disseminate or use such information in any manner other than as expressly permitted by the Company. The User shall be responsible to ensure privacy, security and anonymity of all customer data in the User’s systems during the usage of the Services. It is clarified that the following shall form exceptions to the confidentiality provision hereunder: (i) information which is, or becomes available to the public through no fault of the User, (ii) information disclosed pursuant to applicable law, any governmental, judicial, quasi-judicial, administrative authority, provided that the Company shall be intimated prior to such disclosure having been made.

The Company collates information about the Users’ use of the Services (including details of the third parties / financial institutions with whom the Users transact); and may use the same for statistical appraisals / analyses or other reasons of like nature, while endeavouring to ensure that there shall be no revelation of any personal data belonging to the Users.

8 Fees and Funds Settlement

The User shall pay the Company a fee for the use of Services (“Fees”). The Company reserves the right to revise applicable Fees from time to time, and shall keep the User informed of such revisions within a reasonable period of time. The Company shall not be liable in any manner for any delays / system failures / breakdowns / issues on account of (i) scheduled or unscheduled downtimes at the end of any third party that forms part of the chain for the provision of Services, and / or (ii) any virus attack, contaminants, software / security breaches, or other events of like nature. The Users shall bear and be liable for the payment of all relevant taxes in relation to the payments made under these Terms of Use. The Company shall be entitled to charge applicable taxes on the Fees from time to time. The company in its sole discretion can waive off such fees for any time period it deems fit. In cases of any disputes concerning Fees payable or the settlement procedure, please reach out to the Grievance Officer.

9 Suspension of account

The Company reserves the right to suspend User accounts (or to close or limit the usage in any manner) at its sole discretion, including for the following reasons: (i) KYC details of the User being inaccurate, incomplete, false or misleading, (ii) User breaching these Terms of Use or the other policies of the Company in any manner, (iii) User providing incorrect data or information to the Company, (iv) User being in violation, or having violated any applicable laws or guidelines.

10 Restricted Actions

The User explicitly agrees that it shall not at any time deal in any manner (while using the Platforms or Services or otherwise) with the following: (i) adult goods and services, including pornographic materials (through any medium), prostitution, website access or memberships to pornographic or such other sites or applications, (ii) alcohol, tobacco or any related products, (iii) body parts / organs, (iv) spam tools / bulk marketing tools, (v) devices intended to obtain cable and satellite signals for free, (vi) any child pornographic materials or materials involving minors, (vii) copyright unlocking devices, (viii) unauthorized use of intellectual property of any person, (ix) counterfeit or fake goods without authorisation of production, use or distribution, (x) drugs and pharmaceuticals (including illicit drugs) / drug test circumvention, (xi) endangered species (plants, animals or otherwise), (xii) gambling, betting, games of chance, lottery tickets, sports bets, gambling sites, poker (whether online, offline or otherwise), etc., (xiii) counterfeit documentation such as government ids, etc., (xiv) hacking materials, (xv) any type of illegal goods or goods or services enabling illegal acts, (xvi) miracle cures, (xvii) libelous, defamatory, slanderous, insulting, derogatory, etc. content, including content which could be seditious, or cause disharmony or promote or incite intolerance, hatred or violence, (xviii) offensive goods including firearms, explosives, arms, armaments, etc., (xix) regulated goods including batteries, industrial chemicals, pesticides, etc., (xx) financial products, (xxi) currencies, (xxii) animal trading, (xxiii) any illegal, unlawful or immoral business, (xxiv) any business that may jeopardise the use of the Platforms or Services and that could result in losses to any person, (xxv) ambiguous / vague businesses, (xxvi) cryptocurrency, NFTs, or any virtual currency or tokens or other instruments of like nature, (xxvii) money laundering activities, etc. This list is subject to being modified by the Company from time to time without any prior notice to / consent of the User.

The user shall not use the platform to liquidate their credit cards by transferring to friends or family and circumvent the bank to withdraw cash.

The User shall not use the accounts on the Platforms for any of the abovementioned activities. Users are also strictly prohibited from unauthorized use of the Company’s systems or Platforms.

11 Transaction disputes

The User may dispute a transaction anytime until 7 days from the date of transaction. Disputes resolved in favour of a buyer may result in reversal of payment i.e., a chargeback. In case of any disputes relating to the flow of funds, we will notify / intimate the User.

12 Technical problems

Please raise a ticket with our Grievance Officer in case you face any technical difficulties or issues.

13 Force Majeure

The Company shall not be liable in any manner if the performance of any of its services or actions are delayed as a result of a force majeure event which means and includes any event that is not in the Company’s control, including but not limited to war, acts of god, directions under law or judicial authorities or the like, hostilities, armed conflict, act of foreign enemies, riots, insurrections, labour stoppages, outages and downtimes, fires, typhoons, cyclones, pandemics, etc.

The provision of Services by the Company are dependent on the actions of certain third parties, including third party service providers and the User agrees and acknowledges that there may be a delay / breakdown in the provision of the Company’s Services due to any issues / breakdowns at source level.

14 Privacy Policy and Grievance Redressal

Please refer to the Privacy Policy attached with these Terms of Use for details in this regard. The details of the Grievance Officer are also provided in the Privacy Policy.

15 Disclaimers
  1. You understand and acknowledge that all settlement of any funds shall be subject to completion of know-your-customer obligations required to be complied with under applicable law, including under the mandate of the Reserve Bank of India (“RBI”); and that the Company reserves the right not to release settlement amounts to You / may reverse the funds to the account from where the payments originated in line with the Company’s policies and these Terms of Use
  2. These Terms of Use shall be subject to such revision or amendment or alteration as acceptable to the Company from time to time (which revisions, amendments or alterations shall at no time require any prior intimation to You). Such revisions, amendments and alterations shall be effective at such time and in such manner as acceptable to the Company.
  3. The User is responsible for: (i) keeping updated with these Terms of Use from time to time, (ii) understanding and ensuring compliance with all applicable laws at all times, including the guidelines issues by the RBI and all anti-money laundering laws, as may be applicable to the User in connection with the User’s business and with the use of the Services.
  4. The User agrees and understands that the Company may (permanently or temporarily) cease to provide the Services (or any components or features thereof) at its sole discretion, and without any prior notice or intimation. The Company reserves the right to disable the User’s account and to prevent the User from accessing the Services / Platforms / any part thereof. The Company shall endeavour to keep the User intimated as to any action taken in this regard.
  5. The User has agreed to avail of the Services of the Company at its sole discretion and after having understood and agreed with the Terms of Use and the various policies of the Company. The Company disclaims any liability / authenticity of any information that may have become outdated.
  6. It is our endeavour to provide the Services as smoothly and seamlessly as possible, to make this a helpful experience for the Users. Please contact the Grievance Officer in case you see any issues / have any concerns and we will respond at the earliest.
16 Governing Law, Jurisdiction

These Terms of Use and any dispute or claim arising hereunder shall be governed by and construed in accordance with the laws of India.

Users agree that any legal action, claim or proceedings arising out of these Terms of Use or in connection with these Terms of Use may be brought exclusively in the competent courts / tribunals having jurisdiction in Bengaluru, India and the Users irrevocably submit themselves to the jurisdiction of such courts/ tribunals.

Services

The company provides payment services to users which allows them to make business transactions using multiple modes of payments like net-banking, debit & credit cards. This also includes adding of their vendors bank account details, verifying the same and storing the details in their account for future payments.
